That’s a good question, as that slogan is calling for a violent act, yet it is calling for it in the context of the application of a state-sanctioned criminal penalty. If I had to guess I’d say it was legal. “Categories of speech that are given lesser or no protection by the First Amendment (and therefore may be restricted) include obscenity, fraud, child pornography, speech integral to illegal conduct, speech that incites imminent lawless action, speech that violates intellectual property law, true threats, false statements of fact, and commercial speech such as advertising.” I suppose that someone could try to make the argument that such a slogan might incite imminent lawless action if someone wore such a shirt at a Trump rally and someone else tried to hang Trump because the slogan “incited” him. I think that contention would be laughed out of court, however. Perhaps the takeaway message here is that if you go round wearing clothing encouraging random violence, you’re an arsehole. In the USA the First Amendment to the Constitution protects most speech, including political speech. Thus in the USA wearing such a shirt, as a form of speech, is legally protected. As FDR died in 1945 there seems to be little point in such a slogan, on a shirt or otherwise, but if that’s your intention, go ahead. Of course someone might take offense and push back at you, but the Constitution isn’t protection against private outrage.
